Terms of Service

1. General Provisions

1.1. These Terms govern the use of the website at marketmed.eu (the "Service"), operated by Be1x sp. z o.o., ul. Strażacka 54d/40, 35-312 Rzeszów, Poland, VAT ID PL8133886490, KRS 0000995721 (the "Operator").

1.3. Definitions:

  • User — a natural person engaged in professional or commercial dental-industry activity who uses the Service.
  • Account — the User's personal password-protected profile in the Service.
  • Marketplace — the Service section listing dental equipment offers from third-party Sellers.
  • Valuation form — the form at /sell for submitting equipment for valuation.
  • Seller — a third party publishing an offer in the Marketplace; the Operator is not a party to the transaction.

2. Scope of Services

2.1. The Operator provides the following electronic services free of charge:

  • access to editorial content (articles, events calendar, brand catalog);
  • browsing equipment listings in the Marketplace;
  • submitting the equipment valuation form;
  • creating and maintaining a User Account;
  • saving offers to a personal watchlist (when signed in);
  • subscribing to the newsletter.

2.2. The Service requires an Internet-connected device with a current browser supporting JavaScript and cookies.

3. User Account

3.1. Creating an Account is voluntary, free of charge and required to view prices and Seller contact details in the Marketplace.

3.2. Registration is intended for individuals working professionally in the dental industry (dentists, technicians, clinic owners, equipment wholesalers). The Operator may verify the User's professional status.

3.3. The User must provide accurate registration data. Providing false data may result in suspension or deletion of the Account.

3.4. The User must keep their password confidential and not share the Account with third parties.

3.5. The User may delete the Account at any time by emailing [email protected]. Deletion permanently removes Account data and all saved offers.

3.6. The Operator may suspend or delete an Account in case of a breach of these Terms, after prior notice to cease the breach (except for serious breaches warranting immediate action).

4. Valuation Form (/sell)

4.1. By submitting the form at /sell, the User requests a free, non-binding valuation of their equipment by the Operator.

4.2. A submission is not an offer in the legal sense and does not create a binding contractual relationship.

4.3. The Operator will respond within 5 business days with a preliminary valuation or follow-up questions.

4.4. The Operator is not liable for rejecting a submission or not providing a valuation, in particular when the equipment falls outside the Operator's current commercial scope.

4.5. Form data is processed according to the Privacy Policy.

5. Marketplace — Nature of Listings

5.1. The Marketplace is an information platform aggregating dental equipment offers from third-party Sellers, including (but not limited to) the Dental Outlet platform.

5.2. The Operator is not a party to transactions between Users and Sellers. The Operator does not sell, store or ship equipment shown in the Marketplace.

5.3. Any contracts concerning equipment shown in the Marketplace are concluded directly between the User and the Seller on terms agreed between them.

5.4. The Operator makes reasonable efforts to keep listing data current but does not guarantee availability, completeness or accuracy. Users should verify offers directly with the Seller before transacting.

5.5. Prices are shown in PLN for information only. The final price is set by the Seller.

6. Saved Offers

6.1. Signed-in Users may save Marketplace offers to a personal watchlist accessible from the Account.

6.2. The watchlist is visible only to the User and is not shared with third parties.

6.3. Saving an offer is not a reservation and does not commit the User to purchase.

6.4. The Operator does not guarantee the continued availability of saved offers — Sellers may withdraw equipment at any time.

7. User Obligations

7.1. The User agrees to:

  • use the Service in accordance with applicable law and good practice;
  • not provide false data or data that infringes third-party rights;
  • not interfere with the operation of the Service (e.g. attacks, large-scale scraping without consent, bypassing security);
  • not redistribute Seller contact details or other Marketplace data for mass commercial use (e.g. building lead databases).

8. Operator's Liability

8.1. The Operator endeavors to keep the Service available continuously but reserves the right to temporary downtime for maintenance and updates.

8.2. The Operator is not liable for:

  • the content, quality, technical condition or accuracy of listings published by Sellers;
  • the conduct or outcome of transactions between Users and Sellers;
  • damages arising from use of the Service, except those caused intentionally;
  • Service interruptions caused by factors outside the Operator's control (force majeure, infrastructure provider outages).

8.3. These limitations do not exclude liability to the extent it cannot be limited under mandatory provisions of law, in particular with respect to consumers.

9. Complaints

9.1. Complaints concerning the Service (not Marketplace offers — those are directed to the Seller) may be sent to [email protected].

9.2. A complaint should include User contact details, a description of the issue and any requested remedy.

9.3. The Operator will respond within 14 days of receipt.

10. Personal Data and Cookies

10.1. Personal data processing is described in the Privacy Policy, which forms an integral part of these Terms.

11. Changes to These Terms

11.1. The Operator may amend these Terms in case of changes in applicable law, addition of new services or organizational changes.

11.2. Users will be notified of changes at least 14 days in advance via the Service and (for Account holders) by email.

11.3. Users who do not accept the changes may delete their Account at any time (section 3.5).

12. Final Provisions

12.1. Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Electronic Services Act and the GDPR.

12.2. The court competent for the Operator's registered seat has jurisdiction, subject to mandatory consumer-protection provisions.

12.3. These Terms enter into force on the date of publication in the Service.
